Hi Seniors,
Myself Hrishikesh. I was called for an interview for HR Executive in a company. When the interviewer was interviewing me she asked me one question. The Question is like that suppose her company have total manpower working around 100. So, while in case of PF & ESI registration, if they show them only 40 manpower working and hide the rest, then that practicing is healthy or unhealthy for the company. Is there any chances of arising of problem in future. And will the company be profitable by practicing this types of works.
Seniors are requested mainly for explaining the whole in details. I want in details.

Hi Hrishikesh,
Please join the company which is ethical and your senior has the right knowldge of the law. Question itself is wrong and you can't fool the law always. There are multiple entries in diffrent registers with secuirty, HR, finance etc .
Manipulation is posssible, but you should be samrt enough to do that. But your company owner and directors carry the big risk of litigation.

First of all, let me tell you that its just an interview question to judge your knowledge and not that the company will be practising the same.
To answer such question, the reply should be:
Its illegal to hide the rest of the 60 employees as per the Provident fund and Miscallaneous Act 1952. If an employer has 100 employees and whose basic +DA is more than Rs 6500(which is the wage cieling limit for PF) must register all its employees. But as per the process of registration mentioned by the EPFO, the employer should send a list of all the 100 employees along with their BASIC +DA to the EPFO.
The consequences of not doing so will result in heavy penalities and imprisonment of the employer.
Such a company cannot be earning any profits in the present or future.
It was a tricky question to check your knowledge.

Thanks for your reply. Ya I know that it is an interview question. Even the same question was thrown upon me at the time of interview. So, i curb that situation tactically. But, after some days i came to know from other sources that the company doesn't have any pf and esi for the employees. Now, since they have not selected me so now m thinking of complaining this matter to the regional office.

Well in that case my friend, I agree with your emotions.
Well, yes you can do that but then you too have to face such consequences because of few reasons:
a) one you are not an employee of such company
b) second, they have not selected you in the interview and then again, they can try to prove it that you are trying to take a grudge out of it
c) main reason is that instead of you reporting and getting into such activity, you can try find better jobs in the market as then you will not have to waiste your time.
I am not saying that you are not doing a bad job. But imagine if such companies are indulge in such practices and the employees of the company are not taking any step and happy to continue, then an outsider has limitations to talk about it.
Plus they can also spoil your reputation in the market as well they do have the power to black list you as well. Instead you upgrade your knowledge on HR and payroll and happy searching for a better job.

Current notification issued by ESI & PF authority to increase target of Contribution Profit Percentage for the financial year 13-14.
So, be careful.

Dear Friend,
My friends have expressed their views. Most of the companies are following the law and not hiding. But some of the Management have been manipulating the figures. But, during the course of inspection by the statutotry bodies like ESI, PF, you have to pay the price. They not only claim the contribution, but also you to make the pay the interest and damages. They will go through the ledgers, pay roll etc.
In addition, if you cover partial employees and deny the benefit to rest of the workmen leads to bad IR in the industry.
The interviewer just checked your ethical standard.
