Under the tamilnadu shops and establishments act (section 11 closing of shops and grant of holiday)
My question is We can get exemption from this section 11? If it possible means what is the procedure for getting exemption?

In order to get exemption from sections like closing of shop at a certain time (at night) or prohibiting business after a certain time at night and keeping the shop closed for one day of 24 hours in a week, you have to establish to the satisfaction of the appropriate authorities that keeping the shop opened after certain time at night or on all the days in a week is very important failing which the public will suffer. For example, hotels have been granted exemption from closing it for a day in the week and are given extension in time of closing for the day. These exemptions are given taking into consideration the public who depend on hotels. Similarly, BPOs and IT companies who work for some foreign countries according to their timings are also given flexible timing.

In all these, what is very important is that by means of permitting a firm to work on all the days in a week or extending the closing of shop, no employee should be refused his weekly off and there should not be any employee working beyond 8 hours or 10 hours and 30 minutes including intervals of rest. If you satisfy that employees will be given rolling weekly off and they will be employed in shifts, and also make the authorities convinced that your working for 7X 24 is important for the public, then you will also get the exemptions.
