Dear Seniors,
One of new joinee has not relieved properly from his previous employer and not holding a relieving letter. Our management has accepted his joining but asked me take a declaration letter from the employee stating that in the case of any issue raised by his previous employer, he would handle it personally and with the clause that in the case of any serious issue we would terminate his employment and so on. Kindly share the formats of letter if any.
pls consider this as an urgent request.

Hi,
Kindly take notarized affidavit on Rs. 100 Bond paper stating that, the person has given resignation letter, served notice period and he has completed all the formalities with his last company. he has no dues to pay to his last employer. in case of any legal obligation comes in future then that employee will be alone responsible and not the company.

Whatever the reasons the new joinee is giving for not submission of relieving letter or resignation acceptance letter from the previous employer, get the same statement in writing addressed to your HR department... and you can also ask the new joinee to include one line stating that he / she can be terminated by the management without any reason / or notice period if any issues raised by his / her previous employer in future...
And also, get his or her direct reporting manager / HR persons contact details (name, number, official e-mail id) and you can get the confirmation about relieving in mail...
In private employment, it is always good to ask for the proper relieving letter or resignation acceptance letter from the previous employer, in order to ensure, whether the person is in "dual employment" or not. If we encouraged this, then the person will go and join the other company very soon and he / she will never bother about the process of proper relieving in your organisation...
