I have joined company on 31 dec 2012 and since I have been working with the company (No to specify name). I have been facing issues with the company as they are not providing resources as demanded and in lack of resources I have to work on project and I have also some personal issues. I have resigned from the company. While joining company I have signed a bond for 2 years and payable of 1 lakhs if I left company before 2 years. I did not received any appointment letter from the company uptill now. I am in great mess that could company can sue me for leaving it without paying bond.
The description is I joined company . I signed bond for 2 years for 1 lakhs. I did not received any appointment letter . The bond is 2 way bond and it says that company will provide me training for which I have to work in company for 2 years but still I did not receive any training nor any training thing written on my appointment letter and also they have not sent any mail of training to me .

I have joined college as a Biology Lecturer, on 25th May 2012 and since I have been working with the Junior college (No to specify name). I have signed a bond for 4 years and payable of 2 lakhs if I left college before 4 years.college has taken my All the original certificates (8 original certificates). I did not received any acknowledgement letter for submitted documents from the college uptill now.college has kept my two month salary(42000) as a security deposit for the college as per the contract signed I have been entitled to receive this amount at the time of leaving the college i-e after 4 yrs. From this year they are closing science stream . college authority is asking for the resignation letter from me.what should i do? please guide me.

As an HR Professional, I am not in favour of Service Agreement/Bond. Normally, certain IT companies are into such practice mainly because of their employee-unfriendly HR Policies & practices. They fear that they cannot hold back their employees unless and until there is a bond, giving a psychological pressure to the employees to stay back and work with them at least for two years. Instead of having such Bonds, organizations must have proper employee engagement activities coupled with career growth opportunities, whereby a feeling of belonging generates together with an urge to work for the organization for long.
However, in your case, leaving the organization after 4 months without any proper reason can not be justified. One should realize the time and money spent to recruit and induct a person to the organization. And, of course, you spent your 4 months in the organization and received salary but before leaving the organization have you ever thought of as to what contribution you have made to the organization in lieu of the salary you received. Since you have signed the Service agreement, there is no need of any separate appointment letter as the service agreement normally covers all the terms and conditions of your employment with the organization. Better to consult the HR person and try to settle the issue amicably. And, do not leave any organization before completion of at least one year.

The Bond signed by you is legally invalid as they have got it signed without issuing you any offer of appointment. Such an act by an employer constitutes "fraud and misrepresentation". The facts clearly indicate breach of trust from the employer's side. If that employer serves you a legal notice and demand money in lieu of discharge of the bond i will strongly recommend you to reply to the Notice through a service matters lawyer. Did you submit Joining Report ? Did you write any letter during the period seeking offer of appointment ? did u get pay slips ? did they deduct PF / ESI from your salary ? You do not worry till they serve you a legal notice.
