Dears,

I am working with newly build medical company and presently we are only 5 and we have started hiring,further I would like to clarify some doubts on Delhi Shop Establishment Act which I read in different weblink. :-

1. How many casual leave and Sick Leave are applicable in each month?

2. In different weblink of Delhi Shop Establishment, it states Casual or Sick leave and some weblink it states Casual and Sick leave. Let me know if both are applicable providing the correct weblink for refrence.

3. Is Sick leave is full paid for that day? Eg. if an employee took one sick leave in 1 month, will he get full salary for that perticular day provided he submits documents.

4. As per my knowlege we do not fall under ESI as minimum Inhand salary received by employee is 20K.

5. If any employee do not avail Sick leave or casual leave on the perticular month, can it be carry forward to next month?

6. For maintaining punctuallity, is it acceptable to deduct salary of employee even if he is 5 minutes arrived late. Office hours: 9:30am to 6:30am. and 1:00 to 2pm lunch hour, we are planning so.

If your all Employees getting salary more then 20k.. esic not applicable..;..
you have to mention point no. 6 in your appointment letter....

Thanks a ton for reply. It was on time solution !!!
Further like I said different weblink states different Delhi Shop Act detail, lastly I want to confirm below points:
1. Sick Leave and Casual Leave are 12 each in an year. I mean 12 Sick Leave and 12 Casual Leave or its 12 total.
2. Since ESIC is not applicable nor we have enrolled under any medical insurance as if now. So, we should pay full day salary to employee for sick leave?
3. Or its mandatory to pay full day salary on sick leave

1 Ans:- Sick Leave and Casual Leave both are 12 in a year.
2. Your employees not covert under ESIC.. that why you have take medical policy for your all employees.
3. It is mandatory to pay full day salary on any leave. lick SL, CL and PL/EL...

How many casual leave and Sick Leave are applicable in each month?......a) leave entitlement is counted yearly not monthly.........as per Act 15 PL/EL and min 12 CL/SL rest upto you (i.e. HR)..........we used to give 7SL, 8CL and 15 PL in our organisation.

for Comp & benift purpuse leaves are as good as a normal working day

5. If any employee do not avail Sick leave or casual leave on the perticular month, can it be carry forward to next month?..............its upto you (whether you want your employee to consume their leaves within the year or they can c/f upto a certain limit)

Do not deduct salary in any circumtances..........any deduction need to be deposited to labour welfare fund with a return..............you can cut 1/2 day leave for 3 late comings
