Hi,
I am working in an organization where notice period is termed as 2 months but I didn't agree for it and didn't sign the appoinment letter which mentioned 2 months as notice period.
I was informed that as an employee of organization I should follow the policy and serve 2 months notice period. Whereas I am interested to serve only a month notice period and handover the stuffs within that time line as I need to travel outside country regarding new opportunity.
Is it legally correct, if I go and say I can serve only one month notice period and you cant force me to serve a month extra. I am just 5 months old in this company, so there is not much dependency with me.
Please advice.

Every company has its own defined notice period.
I can understand your plight of gng abroad for better opportunities. In that case, pls meet the HR and ask what can be done.
Most companies allow the person to adjust his/her pending leaves credit for the said period so that notice period could be reduced.
However as you said, you're just 5 months old in the company, I doubt if you'd have any substantial leaves to adjust against 1 month's notice period.
You can offer the HR that you would serve 1 month's notice period and then you wouldn't be able to cont any further as you've to go abroad (if you've flights ticket, you can show them for genuine plead)
Other option is to pay off the notice period. In other words, as you wouldn't be serving 1 month's additional notice, pay it off with the salary you get for a month.
These are the only 2 way out except of serving 2 month's period.

Hi Raghvan,
Policies depend company to company. Even i was working with a company where the notice period was 2months but i have served only 25days notice period...you need to talk to the management & take them in confidence & make a decent exit & also no company can take legal actions on such small matters.
