One new employee has joined my company in July and till now we have not deducted any PF..and also he has not transferred or withdrawn PF from the earlier company also..we usually start deducting after 6months for new employees..what to do in this new joinee case?

As per the PF statutory Act Contribution should start form the day of joining. If new employee has to transfer his previous account to current account then HR should take step and follow. How can he transfer. For that initially you should allocate PF number for current organisation. Once PF number allocated then immediately contributions should take place.

You are not doing as per the PF Act. You need to deduct and contribute the PF from the date of joining. You may be in big trouble if PF authoritie come sot know this. Please consult your legal team.

How come employee running the show?? is this how pf is deducted in your org? if he didnt withdrawn its his wish.. if he wants to tranfer first thing he needs a pf A/c No. which he dont have becos of no pf deductions.. if this is how you deducts to all employees pls change it by consulting your management..

Dear Deeputty According to PF act, if your company or organization comes in the PF category then pf must be deducted from the DOJ(date of joining) of every employee on his or her basic salary. Meenu

if employees basic pay is more than 6500,is its upto management whether to deduct or not? just clarifying my doubts only..please reply

Dear Friend,
At least start deducting PF from the employee and also contribute employers share with immediate effect.
You can mention his date of joining as of this morth or you can also pay the arrears - both employee and employers with interest.

Form 11 is used for Declaration. That is it. It is proof as employee had PF or not in the previous organisation.
Even if employee basic is above 6500/- and in previous company if he had PF then PF contribution is mandatory. Even due to increment or promotion his basis exceeds 6500/- PF contribution is mandatory. but you can restrict the same to 6500/- no need to contribute on full basic
