Hi,
I was working in a small software firm with 10 employees. I've sent my resignation letter to CEO with 10 days notice period. On the day of relieving, he asked me to serve 1 month notice period as it is mentioned on the offer letter. I asked him that, why this was questioned today? Why not before 10 days (on the date of resignation)? Then he told me to deduct 20 days salary as I was serving only 10 days notice period. I agreed with him.
Then he asked me to collect my documents & salary later. After at least 7-8 phone calls & 3-4 emails, he asked me to come to office to collect. But he gave me only documents not the salary. He told me that, "I'm trying to give you one month salary. You have to wait."
It is already 3 months left. When I called him, he responded that, "Why are you call calling me?..... IS this the right time to call (That time time was 5PM)?.... Call me tomorrow....".
Please suggest me, how to get my salary?

Hi Ajitsatpathy,
Generally company will handover the Full and Final Settlement amount maximum of One month after relieving from the Company. Max they can extended to Two months and should give a call to employee to complete EXIT formality. As they didn't issue your F&F, keep a mail to HR and the MD that your F&F is pending and also ask for the reply on the same, mention that if you don't get any reply from the management then you ll be sending a legal notice to the Company.
I shared my view.. Guys! please correct me if am giving a wrong suggestion.

Dear Ajit,
1-First If you have a Joining Letter and if it is written in your joining letter that you have to give one month notice before leaving the company, in case of failure of the same your one month salary will be reimbursed by the company, than this practice may be applicable but If you dont have any appointment letter n your company issued only an Offer Letter than Offer Letter is of no any use.
2- If you are in the probation Period (less than 9 months) than you are not entitled to pay your 20 days Salary against your Notice Period.
3-In case you Employer is not making you F & F, send a request letter containing your Service length, your good Character and also referinh to your
10 days Notice , surely he will reply you and will clear your F & F.

Dear Ajit,
U r request is O.K. But legally t company is right by seeking deduction for 20 days salary against the balance Notice Period.
It is already mentioned in your offer of Appointment as per your statement and t same has been accepted by you at the time of joining.
But you can ask for your balance dues from t company and they are legally bound to pay the dues to you.

Thank you Ratnakaram, Soniya & Anand. I’m asking him for that 10 days salary only. But he is not responding to my mail & phone call. So should I politely ask again or warn for legal notice?

You are to give 30 days notice
You have worked for 10 days
You need to pay back for 20 days
10 days is to be adjusted from your salary due (as you worked for 10'days)
Why will they pay u for 10 days ? You have to pay them for 10 days more actually
What is the value of 10 days pay ?
Is it worth a lawyer fee that will in the end amount to nothing ?
Better close the matter amicably as you will need his reference for future jobs.

In my case i have served complete 3 month notice period as per contarct they have hold my last month salary that you will get this with your FNF and now two months are been completed and now they are disconnecting my call and not responding to email coorporate office guys are not responding if by chance the pick my call they say we have other employees FNF to be processed you are not alone.I am in need of fund but they are not telling me proper time period

Hi,
I was working with a PVT LTD company where our salary cycle is from 1st-30th every month.I have resigned on 7th of April and my LWD was 20th April.Which means I have given 16 days shortfall of notice period.
My company has given the below adjustment:
1st to 6th April- Normal working days
7th to 20th April- 14 day’s Notice period served against applicable 30 days. Hence, Shortfall is 16 days
16 days- 6 days that you worked till 6th April= 11 days recovery.
Now my Questions are
1: I have to make the cash payment for the 11days?
or
2. it should be:
Normal working days: 6
Notice period served:14days
Shortfall of notice period:(30-14)=16 days
Net pay:{(14+6)-16}=4days(company will pay me)
