Hello All,
Please advice as per the labour laws how many holidays in a year is appropriate or I should approve?
My company deals with US and Canada so I give 25th till 31st Dec off (there is no work then and employees are happy too ) but apart from that how should we give holidays.
Till now, I use to see the Bank Holidays but because I am in South here there is no Diwali holiday and some people do not give EId off some do not give Holi.
Is it holidays are region specific ? I think Central and state govt. has different holidays list?
Also lots of strikes/ bandh occur, every 2 months one bandh will be announced and because there is no bus or autos it is difficult for employees to commute.
The office strength is small and I cannot afford to give them pick and drop. So they get an add on off.
On top they also get Sick Leaves- 10 in a year.
I am a bit confused now because I believe we are giving lots of off. What the law says and can the off be region specific?

Dear Friend,
As per the relevant law, you are required to give to your employees at least 7 days holidays towards National Festival and Holidays. Of the following three days are mandatory:
1. 26th January
2. 15th August
3. 2nd October
You can decide which days to declare as Holidays from the remaing 5 days.

Hope they are in addition to weekly offs and leave with wages, as entitled under the appropriate Shops and Establishment Act.

The list you have prepared is fine. Please do consider which event or festival is important locally and then decide.
"Holi" is an obvious choice up North.

Hi Deepali,
apart form mandate holidays, always try to give flexi holidays. From which an employee can choose to take holiday according to his priority.
As now people from N, E, W & S are spread almost equally in India.
So, best practice according to me is, fixed holiday & Flexi holidays.
For example please see the Holidays list 2012 attachment i have framed for my company.

There are two sheets in the excel sheet to be observed. 8 fixed holidays(sheet1) and 2 flexi holidays choice from the given list( in sheet2).

1. We are an organisation having plants in 19 states of India and we leave the holidays to be decided by the local management. This helps in taking into account festivals of local importance / local statute. (shops and establishment Act, National Festival & Holiday Act etc.)
2. The list has to be different for different regions. For Example Ganpati rates very high in holiday list in Maharashtra but Navratri in Gujarat and Durga Puja in West Bengal.
3. The holiday list shared above may be good for a particular state but may not be suitable for other state. Just take care that the holidays stipulated by local statute are observed which will vary from state to state.
4. The best way is first decide the quantum of holidays your company wants to give and then let the local teams decide on a holiday list. You can also specify how the holiday will be treated if it falls on a Saturday / Sunday or on a weekly off day.
