Would like to know if Minimum wages are applicable to White collar employees .. The doubt is when i found a under graduate who was employed as Peon/ Office boy , with a pay of 8k. While at the same time found a M.com Grad who was in the system for the past 8 months drawing only 5k. I raised this issue to her reporting boss who said for the blue collar ( Office boy ) we must follow the Minimum wage Act ....I dont understand the logic .. Please Suggest ..

Minimum wages act does nor take care of people in managerial,administrative and other white collar jobs.Salary is not a distinctive factor here,its the nature of work done by the employee that differentiates them from each other and purview of labour law act they will fall under.Obviously education or degree of the employee is also not a distinctive factor.

The fixation of minimum wages is not determined by the educational qualification rather on the scheduled employment at which an individual is employed.

Now,for the case of the 2nd employee with M.com qualification you need to see his job profile.

It is logical that an individual with a higer qualification shhuold be offered a better job and as for the minimum wages the peons or similar profiles are considered as "Unskilled " workmen in the shceduled employment and it is my comprehension that the gentlemen with Masters qualification huold had been appointed in a higher grade with your organization so obviously his/her gross salary would be more than that drawn by any employees at "Unskilled level".As such if Rs.8000/ is the rate of minimum wages notified by the labour department of your sate in unskilled employment ,the MW for hiher grade of employees should be more than that of Rs.8000/-

Also to sate that the idea of Minimum Wages determines the minimum of gross salary to be offered to any employee and as such it is applicable to all forms and levels of employment.

Please refer to the latest notification of Minimum Wages as prescribed by the labour department of your state to properly fix up the gross salary for all types of employment.

Thank you for the suggestions. I have checked with the a qualified legal person who said there is no MW for white collar Staff. I doubt on that aspect. As this would be injustice done. The Job profile of that Mcom grad is with Claim settlement , Voucher entry etc , in short all clerical cum back end operations.

The Minimum wages is nothing to do with the white collar job and blue collar job. .The minimum wages is decided by the state government. The government will notify the minimum wages which should be given to the each class of employees. Even minimum wages is fixed for the while collar jobs also. For example the kerala government has notified the MW for software professions and they also includes B.Tech holders who are while collar employees.
