Dear All,
Most of Organization not pay gratuity and earn leave to contract workers. It means, they are not eligible for gratuity and earn leave ? Please inform me the rules for contract worker for leave, gratuity and bonus.

As per the contract act they r eligible but only few contract company pay it but remember they all maintain fake register for the same

As per sec 8 Eligibility of Bonus
Every employee shall be entitled to be paid by his employer in an accounting year, bonus, in accordance with the provisions of this Act, provided he has worked in the establishment for not less than thirty working days in that year.
Gratuity & leave both are applicable for contract workers.
leave calculation 20:1.
or gratuity as per gratuity act (Basic+DA)/26*15=*******

The contract workers are also the workers of contractors and they are also eligible for Gratuity, Earn leave and bonus.
this is a principle employer's liability to pay these benifits to workers.

Dear Rahul ji,
With due respect to you, I would say, I thing you are doing some conceptual mistake in understanding. You said, the contract workers are ALSO the workers of contractor. You further said that it is the liability of PE to pay these benefits to contract labours.
Normally, the contract labours are migrant in nature. They are not employed with single PE throughout. My question to you, under such circumstances how the PE is liable to pay leave, bonus and gratuity for the service which is not rendered to him, or for the service which is rendered to some one else?
