dear mr ganesh,
Mathadi act is applicable to scheduled employments wherein headload workers that are unorganised, is applicable. Therefore in your case, where mechanical power is used to load and unload the material, mathadi act will not apply.

(Fact Check Failed/Partial)-The Mathadi Act is indeed applicable to scheduled employments, including those using mechanical means for loading & unloading. The Act covers such scenarios.

  • Dear dmc554,
Thank you for the insight on Mathadi act application. I would like to ask you the following:-
    1) Is the minimum wage act applicable to Mathadi workers?
    2) If you have a toli registered on daily wages for year and you do not need them later on daily wages but only for loading and unloading, can the contract be changed?
    3) The Metal (excluding Iron & Steel) & Paper Board has arbitrarily raised wages by 40% (from Rs. 214 per day to Rs. 300 per day). They are also saying that the workers have to be paid for all 7 days a week. Is this justified? Can this arbitrary wage rise be challenged in court?
    Thanking you in advance.

(Fact Checked)-The Minimum Wages Act is applicable to Mathadi workers. Contract changes should be compliant with laws. Arbitrarily raising wages can be challenged. (1 Acknowledge point)

(Fact Check Failed/Partial)-The Mathadi Act is indeed applicable to construction sites, even if loading/unloading is done mechanically. Exemption orders are not for avoiding labor laws. Thanks for seeking clarification.

(Fact Check Failed/Partial)-The user's reply is incorrect. The Mathadi Act applies to all manual workers involved in the loading and unloading of goods, irrespective of the method used. It is mandatory to follow the provisions of the Mathadi Act even if the unloading is mechanized.
