I would like to request for guidance on a peculier issue about EPF.

My mother worked in a government aided private school as a teacher. She is entitled to pension & EPF scheme from state government of maharashtra after retirement.

She was working as primary school teacher with EPF account number as "PR/PN/211/1710" until 1997. Then she was transferred to secondary section with new EPF account number "PNA/PMC/56/37075".

The employer (School authorities) did not process the EPF transfer forms for her. (Same for all other transferred teachers).

Now she has retired on 31-Jan-2011. It is more than a year for that, but the school authorities are not processing the EPF forms. I have tried to launch a complaint on EPF greviences website, but these EPF numbers could not be found there. (It seems this website does not cater the state govt. education department employees). Also, we cannot put grevience against EPF office, since the forms are not yet submitted to them.

Now the school has given the forms to a private agent, who asks for money to submit the forms. We have already paid some amount to him, but he does not submit the forms to EPF office.

Can we take any legal action against the school authorities for this delay?

If yes, what would be the proper way to proceed? RTI? EPFO? Lawyer? or anything else?

I would appreciate your views & guidance in this regard. Thanks in advance for your replies!

I doubt whether she will be covered under EPF at all. She may be a member of the State GPF. The account number also does not appear to be that of EPFO. Please check up these facts. Was any account statement given during the service period? Does it say it is issued by the EPFO?

Indeed she is a member of state GPF. I tried to find the Maharashtra state GPF database online, but it is not available yet.
We followed up with local ZP office, & upon a written complaint, the matter is now in persual.
I doubt, there will be any legal action against the school authorities, but at least the pending work is now moving ahead, not only for my mother, but also the other teachers in the school!
