I am a contractor, want to know is there any rule/mandate for employers to provide notice period to contract labor(employees) working through a contractor. give me some link if possible. though nothing is mentioned in the contract about this however i feel there must be something to help my labor in getting some notice period pay for intimating them just 5 days before the termination.

Dear Contractor,
the termination of Contract depends on agreement between employer and contractor agreed a abide to rules made thereunder as your terms and conditions. as a contractor you have to pay retrenchment compensation to your workers if they worked 240 days end of the contract period u/s.25F industrial dispute Act .Calculation as follows :
Last drawn avg salary/30*15 *no.of.Years.

It is very sad but ubfortunately it is a fact. Contract labourers are the worst exploited lot in this country by all...be it Govt organisataions, or Private sector companies who claim to be world class organisations with ethical standing or mediocre companies

No notice pay, no leave, no benefits and no retrenchment compensation

I came across with a BPO who assigned certain jobs to a Corporate Contractor who in turn assigned to a small company who in turn assigned to an individual contractor. Just imagine 10% margin at every level and there is 30% margin available and that will be sufficient to erdicate certain woes of these contract labour

Legaly Mr Gadde is right. However one need not pay retrenchment if an employee is engaged for a specific period and thereafter his services are not required. Many of the contractors will menbtion this condition and renew his employment after some time and there is no need to pay retrenchment compensation I know some contractors even take resignation letters in advance

as a contractor if you want to some good for your workmen, I must appreciate you in this forum even for showing some interset in that direction

I agree with Mr. Naresh and Mr. Sivasankaran.
People always try not to speak on this kind of matter and steal the rights of contract labour/workers but you have shown your interest for their well being and security is really appreciating.
Also I would like to share something with you where you can get that our Govt is also gonna do something for contract labour.

Dear Mr. Contractor,
Since the Employees engaged by the Contractor to do the work of the Company/Organisation are Employees of Contractor and the Company/Organisation is no longer under obligation to give any Notice Period to your employees. If you go through the Agreement (if having) I am sure that there will be mentioned that the Agreement between you (as Contractor) and Company/ Organisation is on Principal to Principal Basis and Company/Organisation is not responsible for the Employees engaged by the Contractor".
Hence in true sense you are a Service Provider providing "Services" to the Company and Company/Organisation is not having any responsibility for your Employees apart from your Bill Payment.
