Respected senior members i would be grateful if you could help me with this situation...
I was working for a well known BPO in bangalore for 5+ years people in office knew that i was going through some kind of health issues, i sent my resignation through email before some complication may happen but no one ever got back to me with regards to my letter I was thinking since some major changes were happening in the process probably my RM wouldn't have noticed my letter. Oneday when i was at work i fell ill and i asked RM to take me to hospital RM pointed me to HR before i reached his desk he just asked me to go home with terrible pain i left office the very next day i was hospitalized tried my relatives tried calling my RM so many times to keep him posted by the time they were able to reach him he informed that i was terminated for returning to work. after taking some rest i came to bangalore to speak to my managers about unfortunatley the process was shutdown meanwhile so i tried talking to HR he was the same guy who sent me home instead of hospital i spoke to him he said everything is over nothing cannot be done since this is my first job i am unable to move on without papers i really dont know what to do still im recovering physically but mentally im distracted badly

please help me how to handle this situation with my old employer

Resignation submitted by e mail is not valid because any one can create an mail ID nd sent resignation. In case U have sent it by mail a post confirmation copy by registered post.I think that the company has taken decision to terminate you. If you do not want serve any more request to collect your dues and relieving letter etc.

I am not able to understand your issue as to what you are looking for. Also, when you describe things, please try to put comma, fullstops...so difficult to understand. But anyways, even if they have terminated you, they must have issued you some letter (termination letter, full and final letter, etc). If they havent, then please ask them for the same or as you worked there for 5 years, tell them that you wold pay for the notice period and then they can issue you the relieving letter. Also, if you have sent them the resignation letter, show it to them. Was it from your personal email or official email? All you need to do is, meet HR head or your PM there...You would need to visit there often to get the work done. Be polite with them and sooner they would definitely issue you the respective letters.

Thanks for your reply with regards to this concern, you are rite i just want to get experience and relieving letter from that company, Due to my health issues i will not be able to work for next 2 to 3 months.. since this was my first job i am little scared that i will not be to move on

You should talk to the HR Head of your previous employer and discuss about your dropping of resignation and the whole incident that happened. Make sure that you carry some relevant medical proofs with you.
Moreover, you can check in your appointment letter, the terms and conditions of termination, whether there is a provision of company paying off the notice period.
If company is not paying you off anything, you can ask for your full and final settlement letter or termination letter in this case.
No company can deny you giving full and final settlement. Moreover, you can also ask for gratuity from the company as you completed your 5 yrs of service.

Approach Local Labour Department Raise a dispute Also send a letter that you are doing tbis as noone is responding Mark a copy to Managing Director of th Company Insist to labour authorities that you want the matter to be referred to Court
If you can get a good advocate engage Spend some money They sure will settle all your dues alongwith certificates

Sorry to hear this from your End i can clearly understand stating that even though you have put paper's they terminated you kindly check through the HR about you Exp Certificate, Relieving Order, F&F, & PF kindly ensure (your notice period pay to be raised from your End if required) kindly let me know whether you were terminated in the ground's of Health Issues or some other Issues......

Just as you have reported the details of the incident , put the same report with the printouts of the communication you had with your RM , Manager and HR in a letter and send it to your employer through a registered post.
You don't have any data to the communication and response from your office, while your relatives were trying to reach your Manager when you were admitted in the hospital. All you have is the document from the hospital , which explains the medical reasons for the absence from work.
Draft your letter with all these details and request the employer for a release of your documents. Offer them an every support they might need , upto buying out of the notice, if need be. However, your medical reasons, should waive you off the need to buy-out. Request them on the medical grounds and offer every document and contacts, they might need to investigate, if at all.
Mention an end date within which they need to respond, no response would declare and escalate the matter to the next level.
Incase , they don't, this letter itself remains a communication to your employment with this firm.
