i have joined an indian oil PSU ON july 2010 at its headquarters. in august 2010 i was temporarily transferred to a peripheral place. i was continuing on this place til feb, 2012 when i received the permanent transfer letter given back dated from august,2010.our company has a policy of giving temporary transfer for only 1 month after which prior approval of personnel deptt is required which was not done in my case.further i was deprived of temporary transfer allowance as the permanent transfer was given back dated. should i raise a grievance with the management?

Transfer is an incidence of service but not a condition of service and it is more so in PSUs who have nationwide network. it is a well recognised principle of administtration that an employer has the previlege to deploy his staff according to his need and even Courts do not interfere with this right of the employer unless there is positive evidence that such transfer was effected with malafide intention. The company might have follwed the required the procedure that is required to regularise your temporary transfer. I therefore do not visualise much support for your claim unless you are able toprove that the tarnfer was effected with malafide intention
