Dear friends,
I am attaching an interesting judgement delivered by Gujarat High Court in which the court has held that part time employee is not excluded from the definition of 'workman' under Industrial Disputes Act and accordingly he could also enjoy the benefits applicable to a workman. Whether he is workman or not is a mixed question of law and fact. It indirectly also accepts the concept of dual employment at the same time.

In CASE NO Appeal (civil) 7986 of 2004 in which the PETITIONER is the General Manager, Indian Overseas Bank and in which the RESPONDENT was the Workmen, All India Overseas Bank Employees Union the Honourable Supreme Court of India in its judgment dated 10/03/2006 had held that part time gold appraisers are workmen as defined under the Industrial Disputes Act 1947. The Bench which decided the issue consisted of their Lordships ARIJIT PASAYAT & ARUN KUMAR. The judgment is available in the website of the Honourable Supreme Court of India.
