Hi friends i want to know that, are we bound to release the incentive of a person who has resigned from the service, can he claim trough the court of law if we refuse to release it. Amit 9780172013

It is not a question of legality but a question of ethics. If, as per the performance parameters of the company, a person has earned his incentives then he must get it. If company decides not to pay his incentives then he cannot claim it from law.

Sanjeev & Pon have given valuable inputs. It is the eithics & values of the company because the employee might have worked hard and supported the company in making business. Ethically he is eligible for the period he worked for, the company might have given it in writing because in general the companies will provide a written documents wrt the variable pay & incentives. If that type of document is available with the employee then he may act accordingly.
In addition to the above by not paying the incentive to the employee you are raising a suspicion / doubt in the minds of other employees who are still with the company and there is every possibility of reduction in the productivity of those people. The company's image / reputation part is also an issue.
