Dear Seniors,
I would require your help in following query regarding PF exemption for Principle employer.
Query 1) In which scenario/case a Contract or a Full time employee working in plant is exempted from PF (i.e) If Basic above Rs 6500/- no PF the Principle employer is exempted from PF liability, subject to Form 11 sbmission.
Query2)If the same is possible then which forms are required to fill as per statutory requirements.

Dear Sir, Kindly send the details rules for the employee having the basic salary above 6500/- & not covered under the Provident fund, also send the respective Form (Form 11)

IT IS VERY SIMPLE THAT AS PER LAW OF PF, THE CAPPING IS Rs6500/- ON ABOVE THIS, IT IS YOUR DISCRETION TO DEDUCT OR NOT BUT YOU MUST HAVE FORM 11 DULY SIGNED BY THE EMPLOYEE DECLARING THAT HE IS NOT A MEMBER OR IS NOT INTERESTED FOR ANY MEMBERSHIP OF PF.
EVEN THOUGH MANAGEMENT WANTS TO DEDUCT THE PF THEN WHAT EVER HIS BASIC SALARY IS THERE, YOU MAY DEDUCT Rs785/- WHICH IS 12% OF Rs6500/- AND CAN DEPOSIT TO THE DEPARTMENT, ONCE YOU START DEPOSITING IT, YOU HAVE TO CONTINUE TILL HIS JOB IN YOUR COMPANY.

1. If he was member in previous company in that case he is not exempted from PF contribution.
2. If he withdraws PF amount from last company then he is exempted from PF contribution.
3. If he is fresher for PF registration and (Basic+DA) exceeds more than 6500/- then that employee have the option.
