Hi,
As we all know retail employees( people working in stores/ retail chains/ shops) work on all public holidays too. In such cases, how do we adequately compensate an employee as per SHops and Establishments Act? Do we give them a compensatory leave or do we have to pay twice the normal wages?

Dear Saumya
As a matter of fact those working on Sunday / Weekly off must be given C/Off in next three days. It means you can divide the Sunday workers in three groups and each one group you give Monday, Tuesday and Wednesday C/Off. In Attendance Register you must mention C/Off instead of Leave/Absence and on Sunday you can show Present.

I was looking at it more from the law point of view. When we look at National holidays when these store people still work, do we give them a compensatory off or give them double the wages?

While on National Holidays if someone works then they will get one present as the same is paid holiday and whatever hours they worked for that period of hours you have to pay double OT. If a person worked for 8 hours in a national holiday he will get 3 days salary. Hope your doubt is cleared.

I am assuming you meant to say that they would get paid 2 day salary for working on a national holiday

No Saumya. One day salary you have to pay whether they work or not as the National Holidays are paid holidays. Further If they work, you have to give them with double OT pay. Hence if a person works for 8 hours on any national holiday then you have to make 3 days pay for that one day or Normal Salary with one C/Off.
