Dear Seniors,
We are going to hire Nepal & Bangladesh residents. They will work in their countries only but will be on Indian payrolls.
Please tell me whether they are coming under PF liability or not?
If yes than on Basic or Gross(International Workers) Salary??

In my view, they cannot be construed as international workers since they are neither Indian employees working abroad nor foreigners working in India and they are working in their respective countries and hence in my view the question of applying PF laws of India to them does not arise and on the otherhand , the indian company, probably will have to comply with the social security schemes, if any, of the respective countries. This can be ascertained.

Sir,
I have discuss this matter with our PF - Enforcement Officer but he advised us to take them in PF liability and treat them as International Worker but some of Indian companies have hired theses employees and deducted PF on Basic salary. So Pl help me out what is right.
