PLZ LETS ME KNOW , IN CASE OF EARNED LEAVE CALCULATION, WE HAVE TO CALCULATE WORKING DAYS /20 , WHETHER THIS WORKING DAYS IS INCLUSIVE OF PL, CL , SL , PAID HOLIDAYS ,MATERNITY LEAVE (3 MONTHS) , W.OFF IS NOT?? PLZ CLARIFY.
WHAT IF TOTAL WORKING DAYS IN A YEAR IS LESS THAN 240 DAYS , ALL PL WILL LAPSED ??? Ex :- 200 days , 210/20 = 10 PL WILL LAPSED ?? EMPLOYEE WILL NOT BE ENTITLED FOR ANY PL FOR THAT YEAR ?? PLZ EXPLAIN ???
IS THIS A LOSS FOR THAT EMPLOYEE??

Dear Mamtha
You have to calculate physical present only for Earned leave calculation. If she is not worked more than 240 days in a calander year you can consider the following for eligibility but you have to calculate the EL only for working days
01.any days laid off
02.Maternity leave availed and
03.Leave earned in the year prior to that in which the leave is enjoyed.
shall be deemed to be days on which the worker has worked in a factory for the purpose of computation of the period of 240days or more, but he/she shall not earn leave for these days. (Factories Act1948 -sec.79)
