Dear Seniors,
please suggest in this case.
we have an employee who is coming after her meternity leave and now ready to join the office.
Now the thing is that,during her absence we placed some body else to take care of her work and her replacement is doing quite well and is on low cost.
Now managenet says that tell the first one to be on leave without pay untill we get a new assignemnt for her.
Since the lady has been with the company since begning and hence doesnt want to say to quit.
Can you please suggest what to write/tell to her to stay in leaves.

Pl. don't do that mistake. You cannot ask any female to stay back without pay after reporting back from maternity leave that too a lady who is working in the company from the begining. If she approaches labopur department etc., then the company has to face the music. Better to identify suitable job and deploy.

The entire episode shows that your organization has not taken any steps to update & improve the efficiency of the old timers & you don't have any career planning activity.

This may be applicable for you also, a smart guy with low cost comes and ready to work in your place then the management may also think about you hence better to plan a structured process for the better utilization of the old timers or you can plan for golden hand shake by planning a good VRS scheme where as they are happy and company also get benefitted.

One more point is that if the employees feel that you are utilizing the services of employees and throwing them out at your will and wish then it goes in to the market and there will be lost insecurity among existing employees and no outsider shows any interest to join your company.

No employee shall be ready to sit idle at home with out pay and that too you are asking her at a wrong time. You are not allowing a lady to continue her work after completion of maternity leave, this comes under victimization & un ethical also. If she approaches labour department or any women community you & your organization are in loop.

This is a sensitive & legal issue, pl. handle very carefully.

As per act you have to provide employment to her and you should pay Meternity benefit also as employer for that leave period(12 weeks-meterity leave) unless she covers under ESI act.
If she approch Labour Department you will be in troble.

this is not the right way to treat an employee who is working in the company from beginning. Every employee is an asset to a company and this is unfair practice which would bring a bad omen to your company. Never ever do this.
