I got retired from the company in 1998,still my Gratuity is unpaid.. I requested but company is not paying my gratuity..plz suggest me what action i should take??

Dear Raj,
It is mandatory for the employer to pay gratuity within one month after retirement/resignation as per gratuity act. First write an e-mail or better would be send a register letter to your employer requesting gratuity. Even if it not done, then straight way approach labour officer/commissioner with a copy of letter/e-mail. It is your 100% right to have your gratuity provided you have completed 5 years services with your employer.

Prashant is right--you have only mentioned the 'situation/problem'.
Solutions can be given to resolve the 'reasons/causes' to change the situation being faced.
Pl talk to the concerned official in the Company & give as many details as possible. More the inputs, better the suggestions from this Forum.

Hi TS,
I am a new user and could not start a new topic (the top right link does not work), but I have the same issue.
My mother was a state govt employee as a lecturer. The govt gave the circular in 2006 that the retirement date was in 2004! So my mother had already worked 2 years. For those 2 years, she was paid the salary. Since 2006 January, she is on pension. There was no overpayment on the part of govt, still they did not release the payment of gratuity (which is usually done smoothly without any requests). No written order has not been given by the govt but the word of mouth from the office clerks is that this money will not be paid becasue she has worked for those 2 years. This does not make sense.
1) How can we get the communication from the govt? Is there any format of a letter that I should write to them?
2) If they do not respond, what is the next step?
3) Is there an RTI act etc that we can take help of?
