The question it self is confusing. The person who has completed continues service of 5years is eligible for Gratuity, and not 5 years experience. Experience can be with more than one employee. Further you can not make such policy that not to pay gratuity. You have to obey the Act and Rules.

As per the court rulings, if a person works continuously for 4 years and 240 days, he is entitled for gratuity.

Company's policy cannot be against the provisions of statutes and hence, it is not possible for the companies to have a policy against the provisions of payment of gratuity.

PF and Gratuity are totally different and governed by separate statutes, namely Payment of Gratuity Act, 1972 and the Employees Provident Fund and Miscellaneous provisions Act, 1952. The only similarity is both are social security legislations.

Every employee who has completed continous service of 5years in an organisation, such an emploee becomes eligible for gratuity payment from such organisation. As per shops and Eshtablishment Act every employee who has continous service of 1year and less than 5years becomes eligible for service compensation. The calculation basis is same in both the cases. The law gives benefit to employee rather than employer. The LAW is above any organisations policy. Policy has to be in line/better than respective Act's but cannot be overruled.
