One of my friend working in RBEI has been terminated considering him for absconding. Actually he had put his resignation one month before. Due to health reasons, he did not go to office for 1 week and failed to inform to his managers, and he also failed to respond to a few calls from his manager. Next week he wrote an e-mail to his manager and stated his medical cause, and also requested to relieve him soon if possible (notice period is 90 days). The manager replied that they have already relieved and asked to meet HR. When he met HR, she said that his service is terminated due to absconding and he will not be provided any relieving letter. Also he needs to pay for his remaining days of his notice period. Moreover, even if they consider to provide relieving letter, his exit will not be considered as clean exit and it would affect in his background verification in other company.
Please provide your feedback and legal rules to save his career.

The information provided doesn't mention if a the failure of your friend is covered by the policy of the organization. It would carry more weight if such incidences were accommodated by this organization in the past. If none, the organization has a winnable case against your friend. Please note that your friend was serving a notice hence was expected to avail her/himself to the organization in order to train the successor for smooth handing over. Unexpected absence may be regarded as a sabotage to the organization if not reported with valid reasons. There's lot that this organization may suspect such as stealing of information for the benefit of next organization. It is also important to understand how your friend used to relate with the management. If relations were not sound, this decision is the result and may not be viewed as a surprise.
