If the establishment area is covered under ESI then WC cannot substitute ESI. In the absence of ESI WC will prevail.

If my registered office is covered under ESI Act, and if i open my branch outside and inside states in india and if i employ less than 10 employees than, ESI is applicable as my other plants.

Dear Sorbani,
If your organization are covered under ESIC act you have to follow certain points:-
Employee whose drawing gross monthly salary up to Rs.15000 are covered under ESIC
and have to deduct the ESIC from employee salary i.e.1.75% employee salary and 4.75%from employer salary. You should file challan in (4 copies) every month at sanctioned SBI branch & also file half yearly return in following manner:-
April to September-by 11th November(40 days from the half yearly closing date)
October to March-by 11th may(40 days from the half yearly closing date)

Hi,
Please clarify the following
Our contractor at our warehouse located in the state of Orissa has informed that the area where our ware house is located is not a notified area as per ESI act and hence he has opted for Workmen Compensation insurance.
My organization located in Andhra Pradesh is covered under ESI Act.In view of this, is it mandatory that our warehouse contractor has to opt for ESI even-though the warehouse locality/area is not notified.

Thankyou for all the information...i would like to know more on this...as to what is the procedure of filing challan and procedure of filing half-yearly return.
Also if i am not wrong. the entire process has a software now..its no more that tedious..however i would like to know the entire process.
Please suggest.
