This is my first thread after the first job joining.because I was a student till now but now a days I am in the learning period through not only share my thoughts with you but also I shall be gain a lots of knowledge from you and by this I can get the best in my life.
I am just joined the first job in a construction company.That's why I want to know about whole function(roles & responsibility) of HR AS LIKE ADMINISTRATION,T&D,INDUSTRIAL RELATION,PF,TA,DA, LABOR LAWS,extra at project site location.
Please give an Information about above mentioned subject.

is it necessary to register temporary office under shop and establishment act , that open for 2-3 years under construction industry to control over the project???? Abhijeet kumar

Dear Abhijeet Kumar
The temporary offices constructed for taking care of Construction Activity is not required to get registered under S&E Act. But the Principal Employer must register himself as an establishment under Contract Labour Act and the Contractor has to obtain the Contract Labour Licence to carry out the Construction Activity in the said premises. Further you must register yourself under BOCW Act also.

As regards to registration of site office of contractors, PMC and principal employer, I would like to share my experience.
One of the Inspectors asked me where it is written that the offices at construction sites are exempted from registration under S&E? This issue was resolved on my questioning him how many such establishments at construction sites are registered with him within his area.
Chapter II Section 7 deals with registration of establishment which runs as under:
7. Registration of establishments.
(1) Within the period specified in sub-section (4), the employer of every establishment shall sent to the Inspector of the local area concerned a statement, in a prescribed form, together with such fees as may be prescribed, containing-
(a) the name of the employer and the manager, if any;
(b) the postal address of the establishment;
(c) the name, if any, of the establishment;
(d) the category of the establishment, i.e., whether it is a shop, commercial establishment, residential hotel, restaurant, eating house, theatre or other place of public amusement or entertainment; and
(e) such other particulars as may be prescribed.
(2) On receipt of the statement and the fees, the Inspector shall, on being satisfied about the correctness of the statement, register the establishment in the register of establishments in such manner as may be prescribed and shall issue, in a prescribed form, a registration certificate to the employer. The registration certificate shall be prominently displayed at the establishment.
My humble request to beginners that they should read the law very carefully and minutely, interpret the same, go thr’ the case laws, amendments and notes to the laws and apply the test of reasonableness.

With due respect to you Sir, can I ask you where it is mentioned in the Act or is there any notification, case law etc.? I know that no construction site is registered under the S&E or under Factory Act.
According to section 7, every establishment is liable for registration under this Act. Establishment means a shop, commercial establishment, residential hotel, restaurant, eating house, theatre, or other place of public amusement or entertainment to which this Act applies and includes such other establishment as the State Government may, by notification in the Official Gazette, declare to be an establishment for the purposes of this Act.
Or the activities carried out in Construction Sites are falling under the scope of Manufacturing Process as defined in Section 2(4)? According to me, yes. Then why the IS&H department is not insisting for registration of such Construction Sites under Factory Act?
I asked this question to many people including officials from LC and IS&H Dept. but no satisfactory reply I got till date.
Can any one reply to this?
