My husband working for a reputed Bank,has resigned from services in lieu of a good offer from other good MNC Bank,as per his offer letter ,he need to serve 90 days of notice period or pay the gross salary of 3 months .Now when he is asking for early relieving as the other bank wants him to join with in 30 days, also ready to buy back the notice period,His bank is mandatorily asking him to serve 90 days of notice period.
They say though it is mentioned in the offer letter for paying the gross of 3 month in case of early exit,there was a internal circular which the banks HR rolled out mentioning it is mandatory top serve 90 days of notice period.
He is in a fix now,as he has already accepted the offer letter from the MNC Bank to join with 30 days,as they were ready to buy the notice period and his company is not allowing him to relieve before 90 days
what can he do in such a situation please advice, asap!!!!!!!!!!!!!11

Hi Garima, I understand your hubby's situation and he have to take early exit from the current employer because he already have accepted the offer from other bank. But the first thing is that your hubby needs to speak to his Boss about it that he need his early leave and if his Boss will permits him, your hubby can take this early exit with paying short notice period amount which will be calculated according to his salary and notice period terms of Employment Contract. He as to convince his Boss otherwise he have have to server this notice period

Hello garima.hajela,
First ask him to talk to the new Bank to extend the Joining time--to the extent possible.
Next, ask him to talk to his boss--like Anil suggested--and get the MAX possible relief in the Relieving Period.
The basic idea being to come to a trade-off timeframe--with the Current employer reducing the Notice Period to some extent & the Next Employer increasing the Joining Time to some extent.
Also, ask him to check out the ACTUAL TIME he would most likely take to complete his pending tasks & do the handing-over. Thus input can be used by him while discussing with his boss--to show that his presence will not be needed beyond that timeframe--unless the bank wants to harass him.
This strategy works sometimes.

I think appt letter conditions prevail. Better to consult a lawyer in case they are adament in releasing him only after 90 days. Pon
