Hi, 27th April is Voting Day in Kolkata. Should that day be announced as an official holiday? regards, Madhumita Roy

Dear Madhumita,
As per Factory Act, 1948, there is no need to announce this day as official holiday, Please see your concerned state or local Administration office (D.M. Office), If there is any notification in regards for such holiday, then you shall have to declare the same.

Dear Madhumita,

In my opinion we are to bound grant paid holiday to the employees in accordance of section 135B of The Representation of the People Act, 1951. The relevant section is given hereunder for your ready reference. Plz go through it finalize the matter accordingly.
135B.Grant of paid holiday to employees on the day of poll. (1) Every person employed in any business, trade, industrial undertaking or any other establishment and entitled to vote at an election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday,
(2) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub- section (1) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.
(3) If an employer contravenes the provisions of sub- section (1) or sub- section (2), then such employer shall be punishable with fine which may extend to five hundred rupees.
(4) This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged.

Hi Madhumita,
we had the same situation in last year in Mumbai.
We had put a mail across to employees stating that those who wish to give their votes can come 2 hrs late to the office.
i think this works, as many of them were in office before 12 and they also excercised their votes.
Thus both the purpose , office and voting were solved. :)

we have declares a HOLIDAY on April 13th, (Wednesday) due to The Kerala Assembly Election 2011. because of our office is in "SEZ" area.

Dear Respectives,
I agree with the view of R.N. Khola. But as according to my opinion if the organistion building is located in the place where either 500 to 800 meter any election booths have. Then according to I.P.C. section,election provision no office premises, outlet should open where have chances of gathering of people. For detail you may contact to local administration, District Magistrate office in this regard. If holiday will announce must be with wage.
If the office is located distant to election booth, then you should have to open the office on election day. Those employee who casting the vote may get 2 to 3 hrs. excuse for come.

Thanks Mr R.N. Khola, i was not updated with the rule that, in the Act it clearly says that the election day should be declared as holiday.
I will put this to higher Management to delare the election day as holiday.

Dear All.
Holiday announce on the day of voting its a statutory requirements as per applied labour Act, If Your industries is continuous plant, you can give them two hours leave with wages.
