Im working for a private organisation since may 2008.Im holding ESI card since last year i.e.2010 from around august.But now there is no deduction in my salary for ESI.Im I eligible to claim maternity benefits now?my E.D.D(deliverydate) is in august .If im eligible what is the procedure?Do i need to go for ESI hospital for monthly check up or not needed?How many days will i get pay from ESIC.?

Benefits under the Act 2. Maternity benefit : Minimum 80 days in the immediately preceding two consecutive contribution periods is must. Maximum period for benefit is 91 days in one year.

Dear Sowmya..
you can claim MB from your employer secondly, you have to produce medical certificate of pregnancy and submit in your organization, you needn't go for any check up anymore and you will get 6 week leave before delivery and rest-of 6 later and you are also entitled for medical bonus which is Rs.1000/-

If an employee has got confined and how she has to get her MB benefit? Kindly give me answer...
And one more thing .... If an employee joins an orgnisation or company and his starting slary is above 20000/- then, should he be inclded in esi? If si. how? Please clear my doubts..

1. Dear member, please go through the literature on various benefits available under ESI Act, 1948 and rules/regulations framed thereunder. . The same can be downloaded from the website of ESIC. In order to claim maternity benefit under said Act, the insured woman must be eligible for the benefit and must get hereself examined in appropriate ESI dispensary and obtain medical certification and submit the same to the concerned branch office of ESIC.
2. Insured Woman/Employee getting "wages" exceeding to Rs.15000/- per month are not eligible for benefits (including maternity benefit) under said Act.However, the coverage of such employees getting wages exceeding to above amount is to be continued till close of contribution period and their eligibility for benefits will be till the close of relevant benefit period.
