Dear Seniors, kindly clarify that what are the leaves are applicable on notice period. Which kind of leave we can compensate on notice period.

It is not just Sick Leave, any leave during notice period can be compensated. We cannot prevent anyone from utilizing his/her leave.

I do not agree to this, as there is no sense in keeping notice period. Notice period is kept so that we can take the replacement and the staff who is leaving the organization can train the new staff during this period. I persoanlly feel that only sick leave and emergency leaves should be allowed during the notie period.

Hi,
Paid leave, sick leave and CL can be taken during notice period, however only after approval. It is advisable not to take paid leave as it can be adjusted againt the notice period and can be encashed whereas the other leaves cannot be.

Notice Period is for employer to find the suitable person to handle the job.It has nothing to do with training the new employee ,that is the headache of organisation.In notice he is entitle to take all the leave , which he/she is entitled other than the earned leave. Earned Leave cannot be adjusted against the Notice Period.

Dear Balaji,
Legally we can not hold any one to avail his/her leave during Notice Period. However, one can be stopped by adding the following para in the appointment letter:-
"In the event of resignation after confirmation you will have to serve full notice period to facilitate a smooth transition. Notice period can not be adjusted in the unavailed leave. In exceptional circumstances only and with the specific approval of competent authority or his nominee may be permitted to pay to the company an amount equivalent to gross salary in lieu of notice failing which resignation will not be accepted and the same will be treated as abandonment of service".

Dear All,
For employer, the notice period is used for smooth transition. For employee, the notice period can be used for finding new job or better job. Hence, leaves of any type should be refused. The out going employee's moral duty is to ensure smooth trasition irrespective of availing leaves.

Normally, basic is considered for the purpose of Notice period. If it is specifically mentioned as gross pay in the appointment letter, then it should be treated accordingly. pon
