Dear,

Disciplinary Procedure is a complex system, starting with showcause, cahrgesheet as per model standing orders or certified standing orders, then if required to hold a domestic enquiry.

Domestic enquiry has an enquiry officer(EO) who is an independant person generally engaged by the employer, Management Representative (MR), Chargesheeted Employee(CE) and a defense representative(DR).

The procedure is just like a court proceeding where EO is the judge and both parties i.e MR & CE has to put their case forward.

Enquiry proceeds with presentation of documentary evidence and also other evidence. There is examination and cross examination of witness produced from both sides.

The full proceedings have to be documented and copies to be given to the other party.

The EO gives a finding report after the finish of the enquiry on which the management has to decide the quantum of punishment.

An employee can be suspended while conducting domestic enquiry. There is no standard format for domestic enquiry.

However if you want to know more about it you can call me on 09326017315
