TN Industrial Establishments (National & Festival) Act, 1958



Important Points

1) Employee means : Any person (including an apprentice) employed in any industrial establishment manual, supervisory, technical or clerical work for hire or reward whether the terms of employment be expressed or implied.

2) Every Employee shall be allowed in each calendar year a holiday of one whole day on the 26th January (Republic day), 1st May (Labour Day), 15th, August, (Independence day) and 2nd, October (Gandhi Jayanthi) and Five other holidays.

3) Where an employee works on any holiday allowed under section 3, he shall at his option, be entitled to twice the wages or substitute holiday with wages on one of the 3 days immediately before or after the day on which he so works.

4) This act shall not apply to any employee in a post of Management or any employee where work in travelling

Important Forms:

Form 1

Every employer shall, within 30 days from the date of commencement of work if they are new industrial establishment, send in Duplicate together with a copy of the notice to Inspector.

Form II

Objection or suggestion, if any to the proposal of the employe shall be sent to the inspector within 15 days.

Form V

Every employer shall send to inspector before December 31st. Every employer shall exhibit this copy on notice board.
