Can anyone let me know, what is complete procedure of trade union elections ( body members ) considering various aspects, viz., Internal Union, external union, when two different unions are there ?

Dear Rajiv,
As per my knowledge Company Management do not have to conduct a Tread Union Election. The Union has to do the Election and Union has to tell their representative to Company Management .

SOME(around 30%) OF the workers have to approach Registrar of TU C/o Office of Labour commr(local) along with a request letter to hold the elections. This request letter is to be duly signed by all 30% employees. The registrar will investigate whether the term of earlier union is over or not. He will then ask the employer to submit alist of all workers employed in establishment. On receipt of the list, the registrar shall depute labour officer to visit the establishment for inspection. Therafter the lection program is decided by election officer and the employer will be intimated accordingly.
AS rightly opioned y Mr Krishnanaik, the Employer donot have to conduct the TU Elections. And if he eventhen initiate the process, it amiounts to Unfair Labour Practices.

The procedure for trade unions elections is simple. For every trade unions election the time period is 3 yrs, it means for every three years trade union has to conduct electons for new representative. The tenure of trade union leader is 3 years. Once the term expires representative of trade union should intimate concerned Joint commissioner of Labout by specifying date to conduct elections and then in presence of JCL leade will be elected and agreement shall be made which will come into forece from the date of elected Leader.

IT is possible to remove union from one's establishment. But it matters very much, as to the union is under Bombay Industrial Relations/MP Ind.Relations Act/Gujarat Industrial Relations Act OR Under Industrial Dispute Act. In case of the first 3 acts, it is rather difficult. Under ID it is possible. But the game is dirty. Better have cordial relations with Union and run the show. Dear all
If the union election tenure is expired and the existing recognized union is not willing to approach the labour department for new election. The opposition party approaches the management not to deal with any union representatives since no union have majority and ask them (union repre.) to attend duties as they are under relief at present.
please advise here what is the management role for further process ?
