Respected Sir,
Kindly help me with the definition of Leave such as PL, Cl & Sl.
is there any law which says less than 3 days of leave can not be treated as PL.
If the company do not offer any Cl & Sl , and offer 1 day leave after every 20 days of physical working, Then too employees one day leave has to be treated as Absent or we can treat it as PL.
If Company wants to give 15 days leave as per factories act , is it possible to divide this 15 days leave in CL & Sl to give benefit to employee to avoid salary deduction for his one or 2 days absent.
Kindly give your suggestion & Reply as early as possible. If provide me links which can help me to prove my points in front of management it will be really useful for me.

Provision for Pl is avilABLE IN FACTORIES ACT, PROVISION OF CL IS AVILABLE IN SO ACT, PROVISION OF SL IS AVILABLE IN ESI ACT IF THIS ACT IS NOT APPLICABLE EMPLOYEE CAN GET THIS LEAVE BY VIRTUE OF AGREEMENT OR POLICY.
PL CAN BE GRANTED MINIMUM FOR THREE DAYS AND FOR THREE OCCASIONS IN A YEAR AS PER FACTORIES ACT OTHER THAN THIS IT WILL BE SOLELY DEPENDS ON MANAGEMENTS WILL. AN EMPLOYEE CAN APPLY FOR 15 DAYS PL IF NO LEAVE IS BALENCE HEN PL CAN BE GRANTED IN CASE OF SICKNESS ONLY

Dear Dipti,
There are no rules for availing minimum days of PL. In some companies the company has the policy of fix number of occassion.
For eg. if in a company an employee can avail PL only for 5 occassion then he can avail half day, 5 days, 1 day, 20 days and 2 days. As long as he does not exceed the occassions.
In some companies they do not have any occassions.
Hence, it can be clarified that PL can be availed half day to any number of days at a time and Factories Act has no rule in this regard.

HI Madhuri,
There are Quater System, Means An employee can take 5 leaves (3 casual+ 2 Sick Leaves ) in 3 Months. And if not availed in 1st 3 months can be carried forwarded.
Extra working days of employees are to be adjusted in Leaves.

First you need to see under which Act you are covered whether you are covered by the Factories & SO Act or By Shop & Establishment Act.
Because both Factories Act as well as S & Est Act provide provision in respect of leave. so it depend on applicablity of Act.
