Hi, Is there any specific date by which salary for previous month has to be paid. Are there any exceptions? My wife gets salary on 25th of following month. Is this valid case? Regards, AMit

Dear,
As per the Payment of Wages Act 1936; the salary date is within 7 days if the number of employees is below 1000 and within 10 days if the number of employees is equal or above 1000, after completion of the month. But the protection of the Act will be provided to a salary upto Rs. 10,000.

Please find out the reason for delay in payment.
If the payment is made everymonth only by 25th of the following month then from the very beginning you could have objected. While accepting the job the question of date of salary does not arise. When we attain self sufficiency then we start discussing about the date of salary, rate of salary, mode of payment, legal implication, etc. If you could have done it in the first month itself and claimed from the office about your right then no one is going to stop you even everybody must have been supported you. But after tolerating till now, if you wake up now,
Think where the mistake is.

Since her salary is above 30,000 per month, she is not protected by payment of wages act.
In any case, one person trying to get relief from the act is counter productive. Its not worth suing your employer unless you have decided not to work any more and have lots to recover from him. Going to court is a costly matter.
however, it is a bad practice not to give salary within 7 days of the month end. It reflects badly on the organisation. It may be a good idea for your wife to look for another job. Many times delay in salary is due to inability of the company to manage cash flows or due to losses. If not, then its a reflection of the attitudes of the owners that they do not care to pay their employees on time. Either way, its not a good place to be.
