Dear Friends, Please guide me- Is it necessary for a company to pay leave encashment as per law or its there will to decide to pay or not to pay?

As per the provisions of the Factories Act, one leave with wages for every 20 days worked to be paid. As per the policy of the company, the ceiling limit of accumulation of the ELs will vary i.e. 30, 60, 45 etc., Beyond this ceiling, the employee will have option to get the leaves encashed on submissiong of a request letter to the management.

Dear Sanjeev shrivasthava, It is oneway good to maintain the cordial relationship between the employee and management as the management encourage the employee not to take leave oftern.

see Sec 79 of factories act 1948 and Every worker who has worked for aperiod of 240 days or more in a factory during a calender year shall be allowed during the subsequent calender year, leave with wages for number of days calculated at the rate for adult: one day for every 20 days of work performed by him during the previous calender year
and also see sub section (5)
See your standing order that types of leave and no of day your actually giving
