Which are the compulsory paid holidays to be paid by an Employer to Employee (Permenant/Temporory/Contract Labour)???

Hello,
Under Factories Act there is NO stipulation for granting PAID HOLIDAYS (distinctly different from and in addition to EL, SL, etc.) at all.
Under the Shops and Commercial Establishments Act the establishment has to declare 15th January, 1st May and 2nd October each year as PAID HOLIDAYS (distinctly different from and in addition to EL, SL, etc.)
Normally and logically when the establishment is CLOSED what would the Temporary Employees and the Contract Labour do in the establishment?
What happens if any employee is required to work on any of these days is also provided under the act but that I would request you to make an effort and find it from the bare act itself. That will speed up process of your own self sufficiency!

Hello All,
In my post of 20th December I have made a factual error. Kindly ignore that response. The correct position at law is that under Sec35(4) the following four days have to be treated as PAID HOLIDAYS. These are: 26th January, 1st May, 15th August and 2nd October each year. The proviso to the same section also provides that if an employee is required to work on any of these days, he will have to be Overtime Wages at twice the average wages AND he also have to be given a paid holiday on any other day.
I regret for having posting incorrect and incomplete information in my earlier post of 20th December!

The national holidays are paid holidays and provision is also made in the act for working on these days well we need to take prior permission from the concerned authorities in advance.

Dear All Kindly Suggest Me.
In my industry contract labour is working. he working on hight. nature of his work is painting. we provided him all safety material but did not use that. unexpectedly he died in accident. i informed to factory inspect and same local police station. Now topic arrise with contractor about his compensation.
Please suggest me regarding this.

Central or State Governments declare holidays for the calender year for the public offices while we are to declare & grant these national & festival holidays for the workers/employees as per the State Shops & Establishment Act or the State Industrial Establishment ( National & Festival Holidays and Casual & Sick Leaves) Act which ever is applicable in your case.
