Dear Seniors
One employee of our organization submit his resignation to management, also he handover his current assignment & charge to another employee, but on last date of his working he delete all important data from his computer.
Can we issue a letter to him and ask explanation or directly launch FIR into police station.
All seniors are requested to suggest me what action will be taken against ex-employee, till date we don’t issue reliving letter to him.

Well we have faced a similar situation too, post that we ensured that we issue a IT policy and in that we clearly mentioned that IT department keeps a track of the websites visited and can even track the files visited too. Also, daily back ups are taken by the IT department. This only helped in ensuring that employees have this mental block that deleting data is useless.
Also, if you look at the situation practically it wouldnt be fun writing n num of letters seeking explanation n wasting your time even when u have data.. the only thing u can do is to wait for his reference check to come n then point that such misconduct has been done.

If an employee has deleted the data you cannot do any thing to him unless you proves the value of the data. FIR will not help you as cyber cell and normal police works differently.
If you can prove the data has been stolen , data was critical and a NDA has been signed up with the client then you have a chance to take action. Also depends if the employee has agreed on papers for data loss.

Employee will easily prove data loss occurred after he has left organization and IT department has the login credentials of the system. You are lucky that employee has not overwritten the data instead of deleting the data from the system else the recovered data would be of no use.

In order to avoid this situation take necessary steps coz even if HR department make policies it will never work if the employee is technically strong and smart. If he is committed what ever rules precaution you apply data theft and data pilferage will occour.
When some one is resigning it is always HR personal and management change their perspective for that employee and their behaviour gets changed.

So immediately start taking backup of the data for that employee. Also data back up should not be incremental as this may cause over writing of the data where the back up is been taking place.

When the employee is leaving let him go, maintain good relationship as you do not know in future he might be your boss in some other organization.
