Hello Seniors
I want to get your views on the matter which is confusing me. If there is sunday on holiday like on Dussehra or 15 August, is it mandatory to give employees another day holiday.

Hi Nandini,
while declaring Paid Holidays for a particular year, these aspects should be taken care of. Suppose your organisation permits 10 PHs, include any other festival holidays if popular holidays fall on sundays in the beginning of calendar year itself.

Dear nandini,
I agree with the correct opinion given by Mr. Ponraj. This is how the number and days of Closed Holidays/Paid Festival Holidays are fixed at the beginning of the year.
No Compensatory Off are given, in case a National/Closed holiday falls on a Sunday (if it is the Weekly Off day and employees are not required to work on that day).

I agreed with ponraj, as he said it should be taken care while declaring the holidays, if the festival and holiday falls on sunday, we can ignore that festival and comsider some other holiday which falls in week days,

It is NOT mandatory to give COMPENSATORY holiday for the holiday that fell on sunday. However, if the company has agreed to declare SUCH number of days as holidays for the year, then it will declare some others as days or give additional holidays for festivals like, PONGAL, DIWALI, DESHARA, etc.

I am soory, but your query is a bit ridiculous. It seems that your company does not have a policy regarding declaration of holidays.
Normally, the Employees representatives (Union) is taken into confidence while declaring Holidays for the ensuing year. The Holidays that fall on off days are not considered at all. Only holidays falling on the working days are normally declared.
I don't know whether you have a union or not. But had there been one, there would not had occurred such a situation as the union never allow a management to declare off day as a holiday.

If a national holiday (Republic Day, Independence Day & Gandhi Jayanti) falls on sunday do you give compensatory holiday for it ???
No...
I think it is not necessary to give compensatory holiday.

Dear All,

In Tamilnadu as per the National and Festival Holidays Act each establishment is required to declare 4 National Holidays (26 Jan, 01 May, 15 Aug and 02 Oct) and five other Festival Holidays in consultaion with the union if you have one.

The 4 NH and 5 FH is intimated to the factories inspectorate for his approval each year and upon receiving the approval it is displayed on the company's notice board for the benefit of employees.

To answer your query what happens if the FH or NH falls on a Sunday. Generally most of the company's give them a holiday for some other festival that falls on a Week day during the year. For example if 15 Aug falls on a Sunday then if Ganesh Chathurthi falls on a week day it is declared and so on.

However, if you choose not to give a compensatory holiday you need to pay one day extra wage (as it fell on a Sunday).

This procedure is practiced by many companies. But in general an alternate day is given to them.

But when the Government declares the list of holidays they generally indicate all holidays including the ones that falls on Sunday. But the Government does not notify any compensatory holiday (may be because the number of holidays declared are numerous and almost all festival holidays are declared holidays).

Trust matter is clarified.
