Can you clarify me that how we can proceed legally to a person who has breached the contract?
What are the legal formalities to be followed and what will be the remedy?
Shall we recover the penalty amount from the breached employee?
It will be very useful for me.

Hi Srinivas,
You need to give more information on the contract you have made and how did the employee went against it. Meanwhile if you want to proceed against him fast consult a lawer who is well versed with company and labour laws.
