We are running a facility management co. and are primarily in to housekeeping and maintenance. Presently many of our staff are employed on minimum wages. Now my question is like this;
Can minimum wage be broken down further in to basic + Hra. Since PF is not applicable on HRA can an exemption be sought? Is there any court ruling which will be able to support this claim.
Illustration: The current minimum wage is Rs. 150/-
Is it legal to have basic Rs. 115/- + HRA Rs. 35/-

Please check out with minimum Basic Wages to be paid to workers ( DA/ Special Allowance will vary according to Government Notification )
So wahatever BASIC + DA prescribed by authority not to bifurcate the same further.
Because someone may come up with an Idea of Bifurcate 150 Rs as 1 ( Basic +DA ) + 149 HRA.
Request you to not to exploit the workers.

During may PF inspection, it have been observed that bifurcation of minimum wages can not be done. PF has to be deposited on minimum wages. Regards,

Dear Vijay, PF Contribution shall be deducted from the whole minimum wages, it can not be spilited as you mentioned. Regards.

Please give complete picture regarding the Minimun Wage and P.F. I am explaining as below please correct me if i am wrong;
1. Minimun Wage, is pescribed as per the Govt. Notification issued( varies State by State). The Basic and the points are given and per day wage rate is given.
For those who are earning Daily, We can contribute the EPF as per daily wage, but what about the monthly salaried.
For. EG. Daily wages is 183 Rs.
So monthly 4758 ( 183*26) should be the basic wage for monthly salary.
And also please provide me the link where it is given that P.F. should be paid on Minimum Wages.

as per my knowledge, u can bifurcate as per your given example.
u have to consider it as given in government notification every 6 months.
currently minimum wages is as follows
unskilled
basic - 3130
DA - 1394
total = 4524
hra is 5% of basic & da
this is the minimum salary u have to pay any how.
