The revised rate of minimum wages w.e.f. 1st July, 2010 i.e. the increase / decrease in Special Allowance for Maharashtra State will be declared in the 1st week of August, 2010.

Dear Mr. Lalit K Jain,
I would like to know how the backwages and consequential benefit are calculated.
I have tried in vain to check how it is calculated or any formula for it.
As per labour court an employee has been given award to be reinstated with backwages and consequential benefit to be paid.
We are in dilemma should we calculate it on basic for back wages , as the employee is asking for full pay with other allowance , HRA etc.
His Last netpay was 10495 and basic for this was 5700.
Please let me know how to calculate.
