I would like to know if the "Factories Act 1948" applies to BPO's in India, If not, what other Acts or Laws apply? If it does apply, then are there any limitations? Thanks in advance to all those who take their time off to reply. Gary.

Dear Gary,
In general we see that BPOs do not carry any manufacturing process at their establishment as defined at section 2(k) of the Factories Act, 1948 & hence they are not found covered under this Act.They are covered under the State Shops & Establishment Act. We are required to go through all the Central & State labour laws keeping in view the number of employees employed at the establishment. To finalize the list of applicable enactments one should go through the applicability clause in every enactment.

this act will apply..
ammendment only limited, u can download IT 2000. it covers the whole of IT and ITES policies which had been framed by india goverment according to our policies.

it mainly covers about
“Digital Signature Certificate”
“information asset”
“licensed Certifying Authority”
“subscriber identity verification method”
“trusted person”
and so on...

The Factory Act 1948 may not be applicable to BPO, as its NOT a'Factory' as defined under the said Act ( mainly because of absence of 'Manufacturing' process). However, all other Labour are applicable to BPO employees as per the applicability of each Act. ... V. K. Bhide

he will give a very clear answer. most of my doubts had been cleared by him
i quoted IT act as most of the people wont accept.
most of the IT companies will follow SHOPS AND ESTABLISHMENT ACT.
IT act was created and it crosses a decade, but its not strictly followed by any govt.
now a days, many states are making use of this act
for an eg.. SYNTEL, a leading IT company is following IT act.
i got these info in my subjects and IT HR's had discussed with us about these act.
