Hi,
My client works in an MNC. I would like to know what are the maximum working hours for an employee in a week?
Also what is the usual break time given to an employee in the day? Is a break time compulsory?
Which Act governs the working of an employee in an MNC?

There is no separate Act which tells about service conditions of employees in an MNC. It depends upon what activity is being carried out in the company. As such, if the company is in service sector the rules relating to spread over, working hours and intervals of rest provided in the State's Shops and Commercial Establishments Act will be applicable. If the company is engaged in manufacturing activity then Factories Act will be applicable. Similarly, if the company is engaged in plantations then provisions relating to working hours, spread over etc in Plantations Labour Act will be applicable. In general, it varies between eight to nine hours and in between there should be at least half an hour break after four hours of continuous work.
An important thing to be remembered is that these are provisions relating to working hours of workers or employees and nothing in these shall be applicable to managerial or supervisory employees.

Hi there,
Being employed in a MNC within India, does not exempt one from application of Labour laws. Ofcourse as an employee of an MNC he could be enjoying benefits much better than prescribed by the law of India.
The law regarding working hours are governed more by practicality to ensure lesser fatigue when the employee comes the next day etc, thus trying to keep their output levels at the maximum.
So the provisions of law regarding working hours if the MNC is an commercial establishment will be as per the SHops Act of the respective state where it is situated. If the MNC is a manufacturing unit then the factories Act will have to be followed.
