Dear Sir
I had received the offer letter from one company & I accepted the offer by signing it. The offer letter contains the following clause:
1. I should confirm the date of joining with in ten days & detailed appointment letter will be issued after joining.
2. Please confirm your acceptance. After acceptance, we both are committed and therefore as per the policy, the notice period of two months would be applicable, if either party withdraws & pay the equivalent compensation.
Due to some personal reasons, I cannot join this company & company is asking to pay the money equivalent to two months salary.
Please advise me, whether I have to pay the money to the company, if I don’t pay the money, Can company take any legal action on the basis of this offer letter.
I need your help in this regard.

Dear Poonam,
Offer letter is given by company to the candidate so that one can think on the Benifit and oppurtunity he is getting and go ahead. As per my understandig says that to except the offer or reject it is totaly on the descrition of candidate.
Once you join the organisation after excepting it and your appointment letter has been issued then the clause of notice period stands. And generally Offer letter do not have clause of notice period.
Now poonam you need to check that what was mentioned in the offer letter ansd have u already confirmed that you will be joining them. Please make it little clear that when was the offer made to you, have u accepted it ,what was the date of joining and when have u withdrawn the offer.
Let me know in more detail.
Thanks and Regards

Hi,
I believe that you have just accepted the offer letter and have not join the organization. You need not pay anything to the company since you have not joined it and if you are on probation period for and you leave without completing your probation period in this case also you will not have to bear the 2 months notice period since you have not been confirmed by the employer.

Dear Poonam,
This is Madhav and I am working in recruitment team for a Level 5 Company, Hyderabad. And we expect that a person will join the company after selecting and accepted for offer letter and we hope that they will join. If they are not joining we are responsible for the loss of an important resource, so by appling such kind of restrictions we can make people join with the company for which they accepted the offer letter.

Dear Poonam,
Offer letter is the letter of intent issued by the company and generally mentions only the details about the position appointed for,the location of appointment and the tentative date of joining.
The letter of appointment issued by the company mentions all the terms and conditions that stand binding to the employee as well as the employer and either of the two parties can challenge the other legally.
In ur case if the offer letter and appointment letters are two different documents,u are not bound to pay them unless u have been particularly adviced so at the time of accepting the offer letter..
