Hi,
There is no law stating that Paternity leave should be given to an employee, but many big coperates are giving up to one week paid leave as paternity leave. It is different for many organistaion. Unlike Maternity leave there is no hard and fast rule for Paternity leave.

PATERNITY LEAVE
A male employee with less than two surviving children may be granted
Paternity Leave for a period of 15 days during the confinement of his wife.
During the period of such leave he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave. Paternity Leave shall not be debited against the leave account and may be combined with other kind of leave as in the case of Maternity Leave.

In NTPC Paternity Leave is granted to a married employee upto two children for one week. As a matter of Policy these are provisions for employees welfare . So it is better to have uniformity as compared to the provisions in the same type of industry. I think there should be penalty also when a third child is born and the paternity leave granted earlier should be made leave without pay and break in service- as a matter of policy. The Unions have to be taken into confidence before doing so. Population explosion needs to be halted. this is consuming all the additional resources being created such as housing, food items and so on. PROSPERITY COMES WITH DISCIPLINE.

Paternity Leave may be availed upto 5 days by married male employees with less than two children.
Maternity leave: 12 weeks off for all married female employees with less than 2 children.
In case of miscarriage, 6 weeks leave is allowed.
These are paid leave but not encashable.

Is there is any Labour law governing this grant of Paternity leave, if so, could any one post relevant portion of the law. Also clarify, if this needs to granted while the wife is confined/admitted for maternity, Is this leave can be availed after couple of months of delivery, that is, can this leave be carried forward for later availing.

Paternity leave may be granted to a male staff member with less two surviving children, for a period of 15 days during the confinement of his wife. During the period of such leave, he shall be paid leave salary equal to the pay drawn before proceeding on leave. Paternity leave shall not be debited against the leave account and may be combined with any other kind of leave. It may not be normally be refused under any circumstances.

Hi,
There is no law in India pertaining or suporting Paternity leave. Its the sole discreation of the company to have a clause in the leave policy for this. Yes, if the company allows the clause in the appoitment letter then he may be allowed 1/2 weeks paid leave depending upon the policy clause.
