An employee is eligible for gratuity if he/she has completed 5 yrs of service. Fractions of a year if below 6 months should be ignored and above six months should treated as a completed year. For example 6 yrs 2 months should be treated as 6 yrs while 6 yrs 6mnths 5 days should be treated as 7 yrs. In case of death the restriction is waived.
Calculation of gratuity :-
Last basic + DA /26*15* yrs of services rendered.
26 means 26 days which is equivalent to one month. Since the employee is getting 4 paid holidays a month he has actually worked for 26 days which is considered as one month for the purposes of gratuity calculation.
15 means an employee's 15 days Basic + DA at the time of retirement/ resignation. To be more explicit an employee gets his last 15 days basic + DA for every completed years of service as gratuity.
