Hi friends, this is a case new to me i heard from some where...
One of employee in orgenisation was died while working in the factory.the factory was started recently.the process was started and at the fourth day the worker was died due to accident in the factory premisis(age of the died worker is 28 years,unmarried,father mother are dependants on him). The factory has licence from inspector of factories,and the worker name is written in the attendance register.
the management want to help his family...
could please see the case and send your valuable suggestions.

Dear G.V.B.VARAPRASAD,
Who is stopping the management to extend statutory & non statutory help to the family members of the deceased employee. Extend help in getting benefit from ESI Corporation & if the worker was not covered under this Act then give compensation as per the Workmen's Compensation Act,1923. Grant exgratia amount to the dependents of the worker. You may also discuss the matter with his dependents.

first thank you for u r reply.
the factory started newly...after his death they submitted the ESI and PF coverage Forms....
So how can they get the Benefit from the ESI & PF.
Can u please EXPLAIN........

Dear G.V.B.VARAPRASAD,
You yourself is writing that he was not covered under the E SI on the day of accident then how ESI Corporation will help you. He was on the rolls of the company. Therefore,if he was working in the capacity of the workman under the W C Act, 1923 then pay compensation as per this Act. Moreover to be on safer side you may see the local ESI Office in this regard.
